What is funds segregation, and why does it matter?
Funds segregation means that your crypto-assets and voucher-related fiat payment flows are kept separate from SMART VALOR’s ordinary company operating funds. SMART VALOR does not hold a general fiat balance for you on the platform.
Funds segregation is performed in line with MiCAR Article 70 and SMART VALOR’s internal safeguarding policies, which require crypto-asset service providers to hold client crypto-assets separately, off-balance sheet, and protected from any claims by creditors. Fiat payments are handled only for a specific buy order or settlement payout and do not create an available fiat balance on the platform.
In the event of insolvency, segregated crypto-assets are intended to be identifiable and returnable to customers based on our detailed custody records, subject to applicable law and the insolvency authority’s decision. In respect of Smart Valor Vouchers, clients may rank as contractual creditors of Smart Valor Liechtenstein.
Where and how are my crypto-assets stored?
Your crypto-assets are stored using Fireblocks, a leading institutional-grade custody platform. Fireblocks uses advanced security measures such as multi-party computation (MPC) and wallet-level segregation to ensure your crypto-assets are held safely and can only be accessed through multi-signature authorization policies.
Note: insurance applies at the infrastructure level; blockchain risks (irreversibility, third-party breaches) remain with clients.
Are my crypto-assets protected if SMART VALOR becomes insolvent?
Yes. Client crypto-assets are legally segregated and held off-balance sheet. This means they are not part of SMART VALOR’s assets and are not accessible to creditors. In the event of insolvency, a court-appointed trustee would be able to identify and return your crypto-assets based on detailed internal custody records and wallet configurations, subject to applicable law and the insolvency authority’s decision.
Where are fiat payments processed?
Fiat payments are processed through accounts with regulated payment/e-money service providers and/or credit institutions. SMART VALOR does not accept general fiat deposits. Fiat payment details are provided only after you create a specific buy order. For example:
- EUR voucher-related payment flows are processed via BCB Group.
- CHF voucher-related payment flows are processed via Equals Pay.
These accounts are used for fiat payments linked to buy orders and fiat settlement payouts and are separate from company operating accounts. Once a payment for a buy order is received and allocated, the buy order is executed. The payment does not become an available fiat balance on the platform.
Can I receive fiat after selling crypto?
SMART VALOR does not offer a general fiat wallet or a freely available fiat balance. You can receive fiat when you sell Digital Assets, or where required by law or a competent authority.
Fiat payouts may occur only as settlement after a sale of Digital Assets or where required by applicable law, regulation, court order or competent authority. After a sale, you will be asked to provide or confirm a verified bank account/IBAN in your name. The fiat amount is then sent to that account.
How does SMART VALOR ensure my funds are not mixed with company funds?
We use dedicated client wallets and dedicated accounts for fiat payment flows that are separate from company operating accounts. System-level controls, strict access permissions, and provider-side transaction whitelisting prevent any co-mingling or misuse of funds. Transactions to or from company accounts are governed by separate approval workflows and cannot be confused with client crypto-assets or fiat payment flows.
Are there legal protections for my funds under MiCAR?
Yes. Under the MiCAR Regulation, client crypto-assets must be safeguarded, protected, and clearly recorded. SMART VALOR complies with all relevant requirements, including those related to custody, insolvency protection, and client rights disclosure.
